Summer Classics of Gabriella White, LLC. Enforces Design Patent and Trade Dress Infringement

On April 10, 2024, Gabriella White, a family of brands composed of Summer Classics, Gabby, and Wendy Jane headquartered in Pelham, Alabama, resolved a year-long lawsuit against Costco for both Design Patent Infringement and Trade Dress Infringement. Summer Classics, the designer and manufacturer of premium outdoor furniture, recently enforced its patent rights against Costco, a multinational membership only retail outlet, for infringement of patent and intellectual property rights in response to the sale of low-cost, replica outdoor seating collections originally created and popularized by Summer Classics. Suit was filed on April 24, 2023 in the US District Court of the Western District of Texas in the Waco Division. 

The lawsuit was settled amicably with Costco; the membership retailer agreed to cease sale of the disputed product and a payment of an undisclosed amount to Gabriella White, LLC.
